Reservations & Scheduling
Payment of a non-refundable $99 Booking Fee and acceptance of this Agreement is required to reserve your session date. The booking fee applies toward your selected package.
Payment, Non-Payment, and Travel Costs
All payments, including the Booking Fee, will be made by Credit Card or PayPal + applicable tax.
If payment is not received by the required dates, the Agreement may be voided at the Photographer’s discretion.
Travel costs and additional expenses (permits, studio fees, etc.) will be pre-approved by the Client and billed separately if applicable.
Rescheduling and Cancellation
Client may reschedule up to 48 hours before the session.
Cancellations within 48 hours may result in forfeiture of the Booking Fee.
If the session must be rescheduled due to weather delays, emergencies, or Photographer availability, both parties will agree on a new date. A new agreement and booking fee may be required unless the change is due to a service interruption as defined in this Agreement.
Location
Client is responsible for acquiring all necessary permits, permissions, or fees for shooting locations, including studios, parks, or private property.
Images, Delivery, and Rights
Image Delivery
The Client will select images based on the post-session image reveal or chosen package.
Final edited digital images will be delivered within 2 weeks unless otherwise stated.
RAW files will not be provided.
Photographer may accommodate minor retouch requests but is not required to do so.
Metal prints or physical products will be ordered after Client’s final selections and typically deliver in 2–4 weeks. Delays will be communicated.
Images are delivered through a private online gallery link.
Client is responsible for archiving images once delivered.
Client’s Use of Images
Client may use images for personal use only and may not sell, license, or allow third-party use without written permission from the Photographer.
Client shall not alter, manipulate, or apply filters in a way that changes the original artistic work.
Photographer credit is requested for all online postings (e.g., @trenelsonphoto).
Photographer’s Use Image Rights
Photographer retains all copyrights to all images created.
Client agrees that the Photographer may use images for marketing, advertising, social media, print, portfolio, website, and promotional purposes unless the Client requests otherwise in writing before the session.
Disputes
Any dispute shall be resolved under the jurisdiction of the Photographer’s business location.
Maximum liability for any claim shall not exceed the total cost of the Photo Session.
Limit of Liability
Client Risks
Client acknowledges that photo sessions may involve inherent risks including but not limited to weather, terrain, vehicles, equipment, lighting gear, props, and environmental conditions. Client assumes all risk.
Dangerous Conditions
The Photographer reserves the right to pause, stop, or reschedule a session if conditions become unsafe or dangerous for the Client or Photographer.
Minors and Pets
Minors must be accompanied by a parent or guardian.
Photographer is not responsible for supervision, safety, or behavior of minors or pets.
Service Interruptions
Services may be delayed or impacted by forces outside of the Photographer’s control.
These include, but are not limited to:

Acts of God, Force majeure (fire, flood, snowstorms, extreme weather, natural disasters)

Government restrictions or closures

Power outages or equipment failure

Illness or emergency
-
Transportation interruptions

Pandemic or epidemic events

Any situation reasonably beyond Photographer’s control
No refunds will be issued for the Booking Fee or payments already made. Photographer will make reasonable efforts to reschedule.
General Release
A reshoot will be provided as the sole remedy if all images damaged in processing, lost through camera malfunction, or otherwise lost or damaged prior to the delivery of the final images.
