Reservations & Scheduling
Payment of a nonrefundable Booking Fee, and execution of this agreement is required to reserve
the Photo Session.
Payment, Non-Payment, and Travel Costs
All payments, including the Booking Fee, will be made by Credit Card or PayPal + applicable tax.
If payment is not received by the required dates, the agreement may be voided at the Photographer’s discretion.
Travel costs and additional expenses (permits, studio fees, etc.) will be pre-approved by the Client and billed separately if applicable.
Rescheduling and Cancellation
Client may reschedule up to 48 hours before the session.
Cancellations within 48 hours may result in forfeiture of the Booking Fee.
If the session must be rescheduled due to weather delays, emergencies, or Photographer availability, both parties will agree on a new date. A new agreement and booking fee may be required unless the change is due to a service interruption as defined in this Agreement.
Location
Client is responsible for acquiring all necessary permits, permissions, or fees for shooting locations, including studios, parks, or private property.
Video Delivery
For The Ember Cut package, the Photographer will deliver raw, unedited video clips with basic color grading applied.

Footage will be delivered within 2 weeks of the session date.

Delivered via a private download link (Google Drive, Dropbox, or equivalent).

Client is responsible for downloading and archiving the footage within 30 days.

This package does not include edited videos, sequencing, audio design, or clip arrangement.

Additional editing services may be purchased separately at the Photographer’s standard rate.
RAW Footage Policy
Client acknowledges that this package provides raw, unedited, color-graded footage intended for clients who want full creative control over their final edit.
Photographer/Videographer Credit
Video credit is appreciated but not required.
However, if you tag @trenelsonphoto, the Photographer will gladly share, repost, or feature your final edit when appropriate.
Photographer/Videographer Rights
Photographer retains all copyrights to all footage.
Photographer may use clips for portfolio, promotional, and marketing purposes.
Disputes
Any dispute shall be resolved under the jurisdiction of the Photographer’s business location.
Maximum liability for any claim shall not exceed the total cost of the Photo Session.
Limit of Liability
Client Risks
Client acknowledges that video sessions may involve inherent risks including but not limited to weather, terrain, vehicles, equipment, lighting gear, props, and environmental conditions. Client assumes all risk.
Dangerous Conditions
The Photographer reserves the right to pause, stop, or reschedule a session if conditions become unsafe or dangerous for the Client or Photographer.
Minors and Pets
Minors must be accompanied by a parent or guardian.
Photographer is not responsible for supervision, safety, or behavior of minors or pets.
Service Interruptions
Services may be delayed or impacted by forces outside of the Photographer’s control.
These include, but are not limited to:

Acts of God, Force Majeure (fire, flood, snowstorms, extreme weather, natural disasters)

Government restrictions or closures

Power outages or equipment failure

Illness or emergency
-
Transportation interruptions
-
Pandemic or epidemic events

Any situation reasonably beyond Photographer’s control
No refunds will be issued for the Booking Fee or payments already made. Photographer/Videographer will make reasonable efforts to reschedule.
General Release
A reshoot will be provided as the sole remedy if all video damaged in processing, lost through camera malfunction, or otherwise lost or damaged prior to the delivery of the final video.
